RERA Haryana: Fees, Rules & How to register a complaint?

RERA Haryana was established in 2017 under Section 4(3) of the Real Estate Regulatory Authority Act (RERA Act) of 2016. Since Haryana is one of the fastest-growing urban states in India, especially in the real estate sector, Haryana RERA is split into two branches: RERA Gurugram and RERA Panchkula. 

The Real Estate Regulatory Authority, or the RERA Act, was introduced by the Government of India in order to regulate real estate in the country and bring about order. The Act states that every state should establish their own RERA in order to oversee the real estate in that respective state. 

What is RERA Haryana?

The Haryana Real Estate Regulatory Authority, or HARERA, is the authority that regulates and oversees the Real Estate Industry in Haryana. Since Haryana is a big state and has several upcoming townships and projects. The Government of Haryana has set up two branches of the Haryana RERA: one for the city of Gurugram and one for the rest of the state, Panchkula. Haryana RERA was set up with the aim of bringing about order in the real estate sector in Haryana and to protect the rights of homebuyers.

  1. RERA Panchkula

RERA Panchkula oversees the real estate sector of the entire state of Haryana except the district of Gurugram. 

The current chairman of RERA Panchkula is Mr. Parneet. Sachdev. 

  1. RERA Gurugram

RERA Gurugram is responsible for the real estate sector in the district of Gurugram. This involves ensuring the smooth functioning of all real estate projects in Gurugram and resolving consumer complaints. Recently, RERA Gurugram imposed a Rs. 5 crore fine on a renowned developer for misleading advertisements. 

Currently, Mr. Arun Kumar is the Chairman of RERA Gurugram.

How to register under RERA Haryana?

To register a project under RERA Haryana, follow these steps:

  1. To register yourself under RERA Panchkula, visit https://haryanarera.gov.in/login/loginview/1 or to register yourself under RERA Gurugram, visit https://haryanarera.gov.in/login/loginview/2 
  2. Select the project registration tab.
  3. Create a user profile by signing up using your email ID and password.
  4. Login using your details.
  5. Enter the basic details of the project.
  6. Fill in applicant details.
  7. Click on save and continue.
  8. Fill out Form-A and pay the required registration fee.
  9. You may download your acknowledgement and save your temporary project ID.

Fees and Charges under RERA Haryana

Here are the fees and charges you incur when making an appeal under the RERA Act in Haryana:

  • To file a complaint before the regulatory authority: Rs. 1,000
  • To file a complaint before the adjudicating officer: Rs. 1,000
  • To file an appeal before the appellate tribunal: Rs. 1,000
  • For an annexure: Rs. 10
  • For an additional affidavit: Rs. 5

Documents required while registering under RERA Haryana

While registering a project as a promoter:

  • Copy of the license along with the schedule of the land. 
  • Service plans showing the services on the layout plan. 
  • Documents relating to the entry of licenses and collaboration agreements in the revenue record. 
  • In the case of a plotted colony, the latest layout plan. 
  • Demarcation plan. 
  • Zoning plan. 
  • In the case of group housing/commercial sites, a copy of the approved zoning plan. 
  • A complete set of the last approved building plans. 
  • Cash flow statement of the proposed project. 
  • Certificate from CA certifying that the information provided by the applicant in Form REP-I-CX is correct as per the books of accounts/balance sheet of the applicant. 
  • Non-default certificate from a CA. 

While registering as a real estate agent:

  • Brief details of your enterprise, including its name, type of enterprise (society, proprietorship, partnership, company, etc.), and registered address, similar to RERA Punjab.
  • Particulars of registration including the bye-laws, articles of association, memorandum of association, etc. 
  • Name, address, photograph, and contact details of the real estate agent (if it’s an individual); in the case of other entities, name, address, contact details, and a photograph of partners, directors, etc. 
  • Copy of the PAN card of the real estate agent. 
  • Copy of proof of address of the place of business. 

How to register a complaint under RERA Haryana

To file a complaint under the RERA Act, Haryana, follow these steps:

  1. Go to the Haryana RERA website at https://www.haryanarera.gov.in/ and select ‘Appellate Tribunal’ from the options.
  2. Next, proceed to select ‘Registration of Appeal with Haryana RERA Appellate Tribunal’.
  3. Enter details and press ‘Submit.’
  4. Keep the online appeal number for future use.
  5. Submit payment for the registration fee.
  6. Generate a copy of the registration form and create a minimum of 5 duplicates of it. Several copies may be required, based on the overall quantity of participants.
  7. Write a thorough request using the instructions provided in Form AAT. Once more, produce a sufficient amount of duplicates and fasten them to the copies of the registration form.
  8. In case of an appeal being postponed, provide a list of explanations for the postponement.
  9. Submit 3 sets of the appeal, attachments, payment draft with fees, and registration document either in person or by mail.
  10. Provide each participant with an extra appeal kit containing their address on the envelope.
  11. You have the option to verify the status of the appeal on the official website. Just input the information of the appeal to find out its current status.
